On 11 December 2023, the South African Revenue Service (SARS) introduced a new approach to issuing estimated assessments for Value-Added Tax (VAT), reinforcing compliance measures for vendors. Why SARS Issues Estimated VAT Assessments
SARS has the authority to request relevant material to verify a vendor’s VAT201 return. If a vendor fails to respond to multiple requests from SARS or submits inadequate documentation, SARS can issue an estimated assessment under section 95(1)(c) of the Tax Administration Act, 2011 (TAA). This assessment, known as a VAT 217, is a calculated tax liability based on available information, often leading to financial and administrative complications for businesses.
Responding to a VAT 217 Assessment
Once a VAT 217 assessment is issued, vendors have 40 business days to submit the required supporting documentation if they disagree with the estimate. Vendors can submit relevant material via the SARS Online Query System, at a SARS branch, or through SARS eFiling.
If a vendor is unable to meet the deadline, they may request an extension from SARS before the expiry of the 40 business days. Extensions are granted only if there are reasonable grounds for the request. Failure to submit the required material within the stipulated timeframe results in the estimated assessment becoming final, leaving the vendor without the right to object.
